THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Legal Duty

Nodal Care Management is required by law to maintain the privacy of your Protected Health Information (PHI) and to provide you with this notice of our legal duties and privacy practices. We must follow the privacy practices described in this notice while it is in effect. If another state or federal law is more restrictive than HIPAA, we will follow the stricter law.

Uses and Disclosures of Health Information

We may use and disclose your PHI for the following purposes without your written authorization:

  • Treatment: We may share PHI with caregivers, physicians, and other healthcare professionals involved in your care management.

  • Payment: We may use PHI to bill and collect payment from you, an insurance company, or another third party.

  • Healthcare Operations: We may use PHI for our internal operations, such as quality assessment, improvement activities, and staff training.

  • Required by Law: We may disclose PHI when required by federal, state, or local law.

Special Protections for Substance Use Disorder (SUD) Records

If Nodal Care receives or maintains records related to substance use disorder treatment (governed by 42 CFR Part 2), these records receive heightened protection:

  • Written Consent: Unlike standard PHI, SUD records generally cannot be used or disclosed for treatment, payment, or healthcare operations without your specific written authorization.

  • Legal Proceedings: SUD records may not be used in civil, criminal, administrative, or legislative proceedings against you without your specific written consent or a court order meeting federal requirements.

  • Redisclosure Warning: Once PHI is shared in a permitted way, it may be redisclosed by the recipient and may no longer be protected by the HIPAA Privacy Rule.

Your Rights Regarding Your PHI

  • Access: You have the right to look at or get copies of your health information.

  • Amendment: You have the right to request that we amend your health information if you believe it is incorrect.

  • Disclosure Accounting: You have the right to receive a list of instances in which we disclosed your PHI for purposes other than treatment, payment, and healthcare operations.

  • Restriction Requests: You have the right to request additional restrictions on our use or disclosure of your PHI.

  • Fundraising: You have the right to opt out of receiving any fundraising communications from us.

Breach Notification

In the event of a breach of your unsecured Protected Health Information, we are required by law to notify you promptly.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the Secretary of the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
